1. NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR TO WIN. ALL U.S. FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED. 2. HOW TO ENTER: To enter the CMO Suite Podcast TUMI give-away promotion, visit and look for the link to enter. Entries will be considered “valid” when an “in-use” e-mail is provided. Both. The interpretation of the terms “valid” and “in-use” are subject to the discretion of The CMO Suite, its parent company Connectivity Holdings and/or any of its affiliates. The term should refer to an e-mail that is actively used by the person entering the contest. ONE ENTRY PER PERSON – Multiple e-mails used by the same person may be cause for disqualification. 3. In order to participate and win you must be at least 18 years of age. This contest will begin on 2/21/19 and will continue through 3/11/19 AT 11:59 PM. One entry per person – additional entries may disqualify you from promotion. Mechanically reproduced copies or photocopies will NOT be accepted. Sponsors, their dealers, agencies, subsidiaries, and any other company associated with this program are NOT responsible for lost, late, stolen, mis-entered information, technical failures beyond their control. ONE winner will be pulled for the $500 item described as a TUMI travel suitcase – retail value of $500. The CMO Suite and/or its parent company reserves the right to cancel the contest at any time. 4. ELIGIBILITY: Promotion is open only to residents 18+. Employees, contractors, directors, and officers of Connectivity Holdings and its wholesalers, promotional sponsors, participating retailers, and all affiliated companies (and the immediate family members of all such employees, and all other with whom they are domiciled) are not eligible to participate in the contest or win prizes. The term, immediate families include spouses, grandparents, siblings, children, grandchildren and those living in their same households. 5. PRIZES: (1) TUMI Travel Suitcase will be awarded to the winner with a value of $500. Shipping will be covered if within the US. Entries from outside the US are required to pay any shipping and handling costs as designated by UPS and/or similar shipping service. The difference between any stated value and the actual value will not be awarded. By accepting a prize, winner agrees to release and hold sponsor harmless from any and all losses, damages, rights, claims and actions of any kind. By participating in this promotion, participants agree to be bound by all the Official Rules of this promotion. The CMO Suite and its affiliated sponsors and ownership groups are not responsible for any cost or alterations that may need to take place for winner to use prize. Winner may be responsible for prize pick-up and transportation. TUMI is not an official sponsor of this promotion/is not responsible for any aspects of this promotion or its prizing and no official sponsorship should be inferred by the give-away as such. Any and all marks or use of TUMI logo is done so to simply identify prize being awarded and paid for by The CMO Suite. 6. ODDS: The odds of winning a prize depend on the number of people attempting to participate in the contest at any given time. 7. WINNER NOTIFICATION AND ACCEPTANCE: Winners will be randomly chosen from all entries received. The Winner may waive his or her right to receive a prize. Prizes are non-assignable and non-transferable. No substitutions allowed, except that prizes and individual components of prize package are subject to availability and The CMO Suite reserves the right to substitute prizes of equal or greater value. The Winner is solely responsible for the reporting and payment of any taxes on prizes or any other required declarations for winning a prize as outlined by their country of acceptance. As a condition of receiving the contest prize, the Winner may be required to complete an affidavit of eligibility and a liability and publicity release, which must be signed at the time the winner claims his/her prize. Failure to sign the affidavit or release, or to comply with any term or condition of these Official Rules, may, at the sole discretion of The CMO Suite may result in winner’s disqualification, the forfeiture of his or her interest in the prize. Except where prohibited, participation in the Contest constitutes the Winner’s consent to the publication of his or her name and image in on-air promotional announcements and other promotional material from The CMO Suite and its use of media, Web sites, and to the inclusion of his or her name and image in any other related publications or Web site for any commercial or promotional purpose, without limitation or additional compensation. The Winner’s list may be obtained by sending a request with self-addressed, stamped envelope to Connectivity Marketing and Media – 715 North Franklin Street – Suite B – Tampa, Florida 33602. 8. PARTICIPATION: Participation in the Contest constitutes an agreement by each contestant to comply with these Official Rules. The CMO Suite and its parent company reserves the right to cancel or modify the Contest if it determines, in its sole discretion, that fraud or technical failures have destroyed the integrity of the Contest. 9. LIMITATIONS OF LIABILITY: By entering the Contest, contestant agrees that any and all disputes, claims, and causes of action arising out of or connected with the Contest, or any prizes awarded, shall be resolved individually, without resort to any form of class action; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred including costs associated with entering the Contest but in no event attorneys’ fees; and (3) under no circumstances will any contestant be permitted to obtain any award for, and contestant hereby waives all right to claim punitive, incidental or consequential damages and/or any other damages, other than for action out-of-pocket expenses, and any and all nights to have damages multiplied or otherwise increased. 10. CONSTRUCTION: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the contestant and The CMO Suite and/or any of its affiliates in connection with the Contest, shall be governed by, and construed in accordance with the laws of the State of Florida, without giving effect to any choice or f law or conflict of law rules or provisions (whether of the State of Florida, or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than the State of Florida. The invalidity or unenforceability of any provision off these rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. 11. GENERAL RELEASE: By entering the Contest, contestants release all participating parties, participating retailers, any other promotional sponsors, and each of their respective parents, affiliated companies, directors, officers, employees, representatives and agents from any liability whatsoever for any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Contest or with the acceptance, possession, or use of any prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light). 12. This Promotion is created by The CMO Suite, whose decisions regarding the selection of winners and all other aspects of Contest shall be final and binding in all respects. The CMO Suite and/or its affiliates will not be responsible for typographical, printing or other inadvertent errors in these Official Rules or in other Contest materials.
